Aethro Network and Subsidiaries - Terms of Service

By accessing or using the services provided by Aethro Network (“Aethro”) and its subsidiaries, including but not limited to Aethro Minecraft Servers and Top Minecraft Servers (“TMS”), you agree to the following Terms of Service (“Terms”). These Terms apply to all users of the Aethro platform, including players, content creators, and purchasers of digital products.

 

 

1. Acceptance of Terms

By accessing any part of the Aethro platform or purchasing digital products through TMS, you agree to comply with and be bound by these Terms. If you do not agree to these Terms, you may not access or use Aethro services.

 

 

2. Changes to the Terms

Aethro reserves the right to update or modify these Terms at any time without prior notice. Continued use of the platform constitutes acceptance of the revised Terms. We will notify you of any significant changes via email or platform notices.

 

 

3. Eligibility

You must be at least 13 years of age or older to use the Aethro platform. If you are under 18, you may only use Aethro services under the supervision of a parent or legal guardian who agrees to these Terms.

 

 

4. Account Registration and Security

Aethro is not responsible for any losses or damages arising from unauthorized access to your account.

 

 

5. Digital Products and Services

All products and services provided by Aethro, including but not limited to in-game items, downloadable content, server memberships, or other digital products, are delivered digitally. No physical items will be shipped. By purchasing any digital products, you agree to the following:

 

 

5.1 Non-Refundable Products

All digital products and services sold by Aethro and its subsidiaries are non-refundable. Once purchased, you will not be entitled to any refunds or exchanges. By completing a purchase, you agree to waive your right to a refund under California state law, to the fullest extent permitted by law, unless the product is defective or otherwise does not perform as described.

 

 

5.2 Delivery

Digital products are typically delivered immediately upon purchase. However, delays may occur due to server or system issues. If you do not receive your product within a reasonable timeframe, please contact our support team for assistance.

 

 

5.3 User Responsibility

You are responsible for ensuring that your system or platform is compatible with the digital products before purchase. Aethro is not responsible for issues arising from incompatibility or misconfiguration on your device or server.

 

 

6. User Conduct

You agree to use the Aethro platform and its services responsibly. Engaging in any activity that disrupts the operation of the platform, harms other users, or violates applicable laws will result in immediate suspension or termination of your account. Prohibited activities include, but are not limited to:

 

• Harassment, threats, or abuse toward other users

• Cheating, hacking, or exploiting game bugs or vulnerabilities

• Sharing or distributing pirated or illegal content

• Using inappropriate or offensive language in chat or forums

 

 

7. Intellectual Property Rights

All content, including but not limited to in-game assets, server architecture, digital products, website design, and logos, are the intellectual property of Aethro or its licensors. You may not reproduce, distribute, modify, or create derivative works of this content without express permission from Aethro.

 

 

8. Purchases and Payment

All purchases on the Aethro platform are final. We accept a variety of payment methods, including but not limited to credit cards and digital wallets. By completing a purchase, you agree to provide accurate payment information and authorize Aethro to charge the specified amount for the selected products or services.

Aethro uses third-party payment processors. Aethro is not responsible for any issues or disputes related to payment processing. Please refer to the payment processor’s terms of service for more details.

 

 

9. No Warranty

Aethro makes no representations or warranties regarding the availability, functionality, or accuracy of its platform or digital products. The platform and products are provided on an “as-is” and “as-available” basis. To the maximum extent permitted by applicable law, Aethro disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

 

 

10. Limitation of Liability

To the fullest extent permitted by law, Aethro, its subsidiaries, employees, or partners shall not be liable for any indirect, incidental, special, or consequential damages, including loss of profits, data, or business, arising from the use of or inability to use the platform or digital products, even if Aethro has been advised of the possibility of such damages.

 

In no event shall Aethro’s total liability exceed the amount paid by you for the specific product or service giving rise to the claim.

 

 

11. Termination

Aethro reserves the right to suspend or terminate your account or access to the platform at its sole discretion, with or without notice, for violating these Terms or for any other reason. You may also terminate your account at any time by contacting Aethro support.

 

Upon termination, all licenses granted to you under these Terms will immediately cease, and you must stop using the platform and any purchased digital products.

 

 

12. Dispute Resolution

Any disputes arising from or relating to these Terms shall be governed by the laws of the State of California, without regard to its conflict of laws principles. You agree to submit to the exclusive jurisdiction of the state and federal courts located in California for any legal disputes.

 

 

13. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
